Lanfaer Depends on the Order. And Kills, no. It was him. God said something to him and banished him from the Garden as well. It is the Devil, and is universally accepted as such. Ya says something to him does not mean it is the devil. it could be someone else giving a message to the devil.

And, lets just say for instance, Kills, that it IS a servant of the Devil. Problem is, ALL servants of the Devil were banished from the Kingdom of Heaven. So, ergo, for it to have existed in the Garden, the Garden cannot be Heaven.
