Since you are paying closer attention to the weapon, you see that the blade is stained with dried blood. But the person offers no resistance when you knock the weapon out of his hand, though there is a bit of sickening tearing sounds as the hand was forced open, and a few drops of blood now drip to the ground.
Katana get!
Kojiro, recovering the katana from a fallen samurai is a noble thing to do, though generally Eta are the ones who would handle the actual physical retrieval for you. Since you are going about this in such a way to limit physical contact with the dead, I would give you only a minor breach of etiquette (which would be a 0 loss for you normally). But since you've done this in a rather haphazard manner and have caused more harm to the corpse, I'm going to have to insist on at least a single point of honor loss, regardless.
@ Kagae:
Finding such a building WILL take time, but eventually you would come across one - a shrine, of all things. It's fairly solidly built, and definitely is filthy as all get-out (though it doesn't smell as bad as the last one). Inspection upon it reveals that any holy symbols or items that were in here have long since been removed.
Against the weather, it's not a bad place to hole up. However, most samurai wouldn't be comfortable with the idea of "defending" themselves in battle within a shrine if they don't have to.
Any other buildings in the city pale in comparison to this one in terms of both integrity and defensibility.
There's always the castle, though.

Denbe was silent, frowning about the whole thing. This guardian wasn't a skeleton, even if he was dead. And it wasn't a friendly gesture. Someone had put a corpse up- whether they'd killed him or not- to try and keep whoever they might except to run into up here away. Possibly just to keep everyone away. It was a disgusting act, stringing up a man like a puppet after his death, to keep intruders out.
The Hare went far closer to the corpse than he would have liked, carefully trying to get a good look at it's flesh without directly touching any of it, peering in and trying to judge roughly how long he'd been dead.

Kagae would find the shrine before going back to the rest of the group looking a bit anxious.
"I found a nice shrine we could spend the night in before we move onto the castle. I really don't like the idea of going into a mysterious castle in the middle of night during a storm where it'll make it harder to hear someone creeping up behind us... What are you doing to the ma- I don't want to even know but the shrine is also a pretty well built place to defend if we find ourselves assaulted at night."
Kagae would retrieve his wicker umbrella in the case of sudden down pour and stand underneath it in such a way it didn't provide cover to anyone else.

Well, I can tell you that after Kojiro's disarm, you can see that someone had sewn his hand tightly closed around the katana. Those threads have now been torn with the force of the chain weapon knocking the weapon away, but there is so few blood drops, it looks like the wounds on the hand have already dried up.
His straw hat is kept low, and it's kind of hard to make out any real details about his face in this fading light. You would need to move the hat before you could make out any discerning features. The act itself is not dishonorable, so don't worry about that. It's up to you to see if you feel like disturbing the body any more than it already has been or not.
The only way to get a look at anything more (torso, legs, etc) would be to undress him at this point.
Seriously, you guys need an Eta.

Standing, Denbe sighed and took a step back, not going to touch the man anymore. He might not have any accurate guess, but he could tell enough from the blood Kojiro had stirred up ripping the hand open.
"I don't like not being able to give him a burial, whoever he is. I can tell you though- who ever did this to him didn't do it long ago," Blood droplets? The Hare didn't think that should be possible if the body had been dead more than a few days, at best. Someone unsavory, or desperate, had been here not long ago.
"I think it's best we assume whoever did this to him won't go far for long. The best we can hope for is that they're holding out somewhere inside and won't be checking by morning to see the katana missing..."
He looked at the castle. If he was holing up here, he was positive that's where he'd go.
"I'm going to agree with Kaiu-san. Let's hole up for the night. Keep a watch, no fires. In the morning we try to make our way to the castle as unobtrusively as possible."

Miyako looked at the corpse, then back at the group. "Uhm..pardon my indelicacies but if he's only been dead a few days...is there any chance that this is the man we were sent to find?" She finally asked the question that they should have been concerned with.

The Scorpion muttered to himself. Innately, he knew that he shouldn't have done something like that, but this felt like an avenue that must be investigated. If anyone could take being called an honorless dog, it should be a Bayushi.
Kojiro put the Kusari-gama away and spent precious time examining the blade, looking for a mon or marks of craftmanship which might be able to tell him who that man was.

Kojiro would pick up and examine the blade. Unfortunately, trying to identify a stranger by way of his weapon alone is a very difficult task, and one that he lacks the qualifications to succeed at.
He does find that it belonged to a member of the Phoenix, though.

Miyako frowned even harder. "So we have a recently dead Phoenix in the middle of the Twilight Mountains where we were sent to look for a Phoenix Clansman..." Turning to the Hare, she rolled her eyes slightly and spoke with a smirk.
"I thought Hares were supposed to be lucky..."Sighing, she bowed her head slightly sending a small prayer to help the man on his way. "With the way this is going, the castle will be stormed out and we'll be stuck here till our rations give out..."Almost as if she'd blame Denbe for it. She was very tired and very sore and apparently this entire 'mission' was a fool's errand.

Rolling up his sleeves, the hare frowned, and sighed, starting by reaching to remove the hat. He would have preferred not to touch him, and hesitated to do more than that... but even if it took touching him, the Hare intended to be sure someone searched this man for anything that might mark his station, clan, family, and information about him that would help them determine if he was the magistrate in question or not. If he could remember something about the physical features of that family of Phoenix, of course, that could help even if he found nothing but...
Distasteful and wrong as this felt, he had to be sure.
