Because he was a ludicrously rich hated man?

hated or not, that is besides the point, Grave-robbery is still considered forbidden and in some cultures a crime. In the sense it is forbidding the spirit rest. Unless if the rules for being a good character has changed that much between 3.5 and 4.0.

I just don't see a group of good heroes, undesired maybe, evil most definite, strolling into a tomb of any one, with out a good cause and the lore of gold doesn't seem to be a good cause to me

we're talking about a demilich who has passed on to the immaterial realm where gold and jewels don't matter. i don't think he'll mind your taking some.
